Got a quote in April and he pushed for us to pay over 50% of our quote to get supplies and secure a job date for concrete. Only did 10% of the work. Excuses after excuses. Took off with over $6000 of our money. Only paid $1100 back to date, still waiting for the rest. Just keeps giving excuses. I cant believe after so many bad reviews and people being taken advantage of, that he is not arrested and in Jail. So pathetic...

Jason has paid me back after 16 months and it was under duress as I phoned him twice on all his three phones. However he still has not paid others back.

From previous situation, Jason has taken our money without building the fence in January 2014. The long winded law and toothless tiger it is lets these people get away with too much and he exploited it.
So far we had approached consumer affairs, then to VCAT who made the order for Jason to pay back the money (May2014) Jason did not attend.

Then to the Magistrate court to make an order for Jason to attend the court and submit his financial statement. I served it and even had to include $10 so that he has money to go to the court. He did not attend. So then I received the letter asking if I would like to issue a warrant, well isn't it obvious.

Another 6 weeks later and he attended the court giving the police a financial statement. He promised in that to pay $250 and then $50 every week. So far I have received $150 and nothing the following week.

The police woman said get legal representation but the amount he owes isn't enough to warrant a solicitor. What can I do, he does not reply to any phone call.

I have had the same experience with Austin Bongart the son. The apple didn't fall far from the tree.

He also does fencing but also does concreting. The concreting job he did for me was beyond *** and all had to be ripped up. Been to VCAT, he didn't show, and makes promises to pay and never does. He will ask for payment arrangements, makes an agreement to stick to it and still doesn't.

He will f***k you around to no end in the hope you will give up, stringing you along with every excuse under the sun. Know of many others who are also owed money. Mooroobool news (local paper) have also ran a story on a customer who paid money and the work was not completed.

I will be asking Mooroobool news to run another story. One of the constables at Bacchus Marsh police has taken several reports about people being ripped off, so they are aware.

I engaged Jayson Bongart from J & A Fencing to construct my front fence. He is from Ballan but advertises in my local newspaper in Newport. A quote was provided on 6 March 2014 of which we accepted. Jayson wanted half of the money up front as a deposit so he could order the material, so I paid him $850 cash on 24 March 2014. He never turned up to do the work and after chasing him up for weeks on end I told him that I wanted my deposit back because he had taken so long and I had now engaged someone else to do the work. Jason kept saying he would drop off the deposit refund but this never eventuated. After calling him numerous times he eventually paid $300. He gave excuse after excuse and said he'd pay $50 per week etc etc which has never been paid back. I'm out of pocket $550 in total. I've given up. DO NOT USE THIS COMPANY I have his home address and have threatened to pay him a visit to try and re-coup my money but he STILL hasn't paid!

Jason Bongart did not attend the Magistrate court at Bacchus Marsh on the 15 Jan. Arrest warrant has now been issued to attend court. Its been 12 months since we paid him, where will it get to and when will it finish?

He tries to justify his reason for not doing the job through his problems. 2 weeks ago he told me that he had work and waiting for his money and when he gets the money he will call me. Don't believe him he does not call you so it's off to the Magistrate court on the 15th Jan 15 to see his financial situation to repay. He also mentioned that he does not want to pay it off at $20 per week, but what else can he do? He stole our money and does not want to give it back. I am in no illusion that he will be doing the fence.

Taken our $1100 to order the fence but no fence

Paid Jason $1100 to order the material for our fence in January 2014, but after at least 20 excuses did not deliver. We still ring him but he never commits to any repayments. I have taken him to VCAT who made an order for him to pay but he ignores it. I am at the Magistrate court now but I wonder what impact this will have. All I can do is to get the sheriff to take his possessions to the value but it's a long way off. Do not give him money even if he says he has to order the material. (It's Jason Bongart from 4 Bank st. Ballan.) There are honest people who will do the fence for you without a deposit.

Abysmal workmanship, made an uneven, wobbly fence which will have to be ripped up as it is unstable, and then tried to blame the owner for leaning on it! Materials used were all substandard/warped - looked like reject timber. The fence posts were not at all secure in the ground, the fence leaned at many different angles, there was sawdust throughout the paint, many palings were split, there was a 10cm difference between the placement of one gatepost and the other, the catch on the gate did not close. I could go on. Do not EVER hire Jason Bongart, he is dishonest and couldn't build a fence to save his life.

Still not resolved - nearly a year. I have spoken to Jason and he makes all the right noises saying to pay it back and he will call me, ha ha.

It is now in the Bacchus March Magistrate's court hands and Jason has to go there on the 15Jan15.

He does not want to pay weekly some $$ but I think that is the only option, now. Meanwhile our fence is falling over.

We received the quotes for fencing 11/12/13. We paid Jason $1100 on the 29/1/14. He said he needs 2 weeks for the materials and we organised that someone would be home on 3 occasions but he never showed. I sent him a letter of complaint. I asked consumer affairs to step in, to no avail. We are going to VCAT 55 King street Melbourne for a hearing at 2.15pm Friday 26/9/14. He is such a liar, with his many excuses and contradictions. He still advertised his business and he was seen doing a job at another place. I cannot warn people strongly enough to steer away from this person. Well VCAT was supportive giving us the order for Jayson to pay with court costs. But he will ignore that now and I am now waiting for VCAT to send me an original copy of the order so that I can take it to the Magistrate court.

Hoping that he will come to his senses and give us back the money.

Ripped off customer

I paid J&A fencing and Gates $1000 deposit in December 2012 for a new fence, after many contacts since placement of order from me and false promises from Jason I still have no fence. I waited 12 months and I then went and lodged a complaint to consumer affairs who sent me to vcat instead, after the hearing I was sent to magistrates court, the next step is the sheriff for recovery of money. All this extra work has cost me more dollars in pursuing this matter. I feel I have lost my money I am so angry. Does anyone have any further suggestions ?

He has cheated many people out of money. I know of 6 people.

I have done the same ; consumer affairs, VCAT, Magistrate court which had cost me all about $230 and he did not bother showing to face it. However when he did not show at the Magistrate court to give his financial statement, I agreed that the police would serve a warrant and from then on he promised to the court that he would pay me back. Next week's payment of $110 will finalise the $610 he owes me. But I have rung him every week to confirm how and when he will pay.

The pitfall is where do you go if he decides not to pay.

The sheriff is powerless to confiscate things of value if they are not entirely owned; e.g. car on hire purchase.

Contracted Jason from J & A Fencing to pull down and replace a fence back in May 2014. Promised it could be done in about 3 weeks. Its now September and the fence is only 3/4 finished and Jason nowhere to be found. It started off with excuses about a broken down car, feeling ill, etc. now he doesn't return calls and have even stopped answering the home phone. Clearly this guy is a shonk with no morals whatsoever - the type that belongs on A Current Affair. Pissed at myself for not checking up on him before getting him to do the job - had I seen these reviews on how much of a crook he is, I would have run a mile the other way.

What fencing???

We were told we would get our fence done within 4 days. He has done around 5 hours of work on this, with not much to show for it. He asked to be paid up front and has been by all of us. The neighbor has started doing the work himself as he is so irate the work has not been completed. Not good when you are paying someone for a service! Don't understand how someone can own a business and treat people like this- how can he justify taking advantage of people? Do not use this company! Where do we go now? Absolute disgrace. Paid 50% deposit then never turns up, always full of excuses. When on the 2 occasions he did turn up he said he was going to be there at 9am, at 10am I rang him to find out were he is. First time he arrived at 10:30 does 2 hours work "pulls one small fence down then goes home" I call him to find out what's going on tomorrow he says he will be working to completion and will be there at 9am turns up at 1pm pulls another small fence down and goes home. Next day he doesn't turn up at all, I now have two neighbours fences down. I will not be held to ransom by this low life. After many let downs I sacked him and asked for my money back. Not a legit business at all Do NOT use J&A Fencing!!!!!

Review for J & A FENCING & GATES – Ballan, Victoria Stay away from these cowboys. It took them two weeks to finish a simple fence. Job should have been done in two days. They over promise and under deliver. Not only was their work well below standard, they couldn't even get the fence construction right. The supporting beams were placed too low. Thats what happens when you send a unsupervised 'bored' teenager to finish the job. When the job was delayed Jason (owner) didn't ring to communicate or update us. He disappeared for days on end. Just don't know how this mob are still in business! He even demanded to be paid before the job was done so we had no recourse for poor workmanship. Trust me - I regret using them. Don't fall for the line "we've been in business more than 30 yrs". Its a ploy to convince you to hire them. Call another fencing company cause this one shouldn't be in business.
